DMCA Policy

Garlic Mushrooms ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Garlic Mushrooms service or website if such claims are reported to our Designated Copyright Agent identified below.

Filing a DMCA Notice

If you are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Garlic Mushrooms website by completing the following DMCA Notice of Alleged Infringement and delivering it to our Designated Copyright Agent.

  1. Identification of the copyrighted work: Identify the copyrighted work that you claim has been infringed. For example, "My copyrighted image located at [URL]" or "My copyrighted recipe titled 'Spicy Garlic Mushrooms'."
  2. Identification of infringing material: Identify the material that you claim is infringing and where it is located on the Garlic Mushrooms website. Provide reasonably sufficient information to permit us to locate the material. For example, "The infringing image is located at [URL of infringing content]" or "The recipe on this page [URL] uses my copyrighted text without permission."
  3. Your contact information: Provide your full legal name, mailing address, telephone number, and email address.
  4. Statement of good faith belief: Include a statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy and authority: Include a statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Electronic or physical signature: Provide your electronic or physical signature (typing your full legal name is sufficient for an electronic signature).

Filing a DMCA Counter-Notification

If you believe that material you posted on the Garlic Mushrooms website was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by submitting written notification to our Designated Copyright Agent. Pursuant to the DMCA, the Counter-Notification must include substantially the following:

  • Identification of removed material: Identify the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
  • Statement under penalty of perjury: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your contact information: Your name, address, and telephone number.
  • Statement of consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Garlic Mushrooms may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Electronic or physical signature: Your electronic or physical signature (typing your full legal name is sufficient for an "electronic signature").
